Smoke and Carbon Monoxide Regulations

As of 1st October 2022 there is an update to the legislation surrounding smoke and carbon monoxide detectors in rental properties which all residential landlords and tenants in England and Wales will need to be aware of.

The existing regulations have been amended, introducing a significant change for many rental properties. Previously, it was only necessary to have a carbon monoxide detector in an room containing a solid fuel burning appliance, however now the legislation states that it is necessary to have a carbon monoxide detector in any room containing a fixed combustion appliance, excluding rooms where there is only a gas cooker.

This means, for example, that it will now be necessary for a carbon monoxide detector to be installed in any room containing a gas boiler.

The changes also mean that landlords are now legally obligated to ensure both smoke alarms and carbon monoxide detectors are repaired or replaced as soon as they are informed that they are faulty.

There is no “grace” period for the changes, meaning that they will come into force on the 1st October 2022 and any landlord found to be in breach of the regulations after this date could face a fairly hefty fine of up to £5000.00 if the local authority serve a remedial notice which is not complied with.

At Hazells we have been advocating the use of carbon monoxide alarms in any room with a gas appliance for many years now, and have ensured that this is the case in our managed properties, since for the small cost associated with installing an alarm (around £15 – £20) it made sense to have them installed to ensure the safety of our tenants. We also check the functionality of both smoke detectors and carbon monoxide alarms when carrying out regular six monthly checks on properties and replacing any old or defective alarms as a matter of course.
